Driving Without Insurance in Toronto — how it actually works

Whether the OPP stopped you on a 400-series highway or Toronto Police Service on the DVP, the Gardiner, or a city street, a driving-without-insurance charge under s.2 of the Compulsory Automobile Insurance Act is heard at whichever of Toronto's three Provincial Offences courts serves that area — Toronto South, East, or West.

This is not an ordinary ticket. There is no set fine — the matter proceeds on a summons, and the minimum penalty on a first conviction is $5,000, which becomes $6,250 once Ontario's mandatory 25% surcharge is added. No demerit points attach, which is exactly why the charge gets underestimated. How this charge is defended in Ontario covers the full penalty range and the due-diligence defence in detail.

Most people don't arrive at this charge on purpose — a cancelled policy, a lapsed renewal, or a vehicle borrowed on the assumption it was covered. Bank records and correspondence with your insurer are usually where a defence starts, and whether the cancellation notice was properly served is often the deciding question.

In our experience

A number of the Toronto no-insurance files we see involve a policy that lapsed without the driver realizing — surfaced during a stop on the DVP, the Gardiner, or a city street. Whether that lapse was genuinely undetectable is usually the heart of the case.

Driving Without Insurance in Toronto — questions we get

How much is a no-insurance ticket in Toronto?

There's no set fine. The minimum on a first conviction under the Compulsory Automobile Insurance Act is $5,000, and with Ontario's mandatory 25% surcharge the real floor is $6,250 — the same across the province, not set by the local court.

Which of Toronto's three courts hears a no-insurance charge?

Whichever one serves the area where the charge was laid — Toronto South (92 Front St E), Toronto East (1530 Markham Rd), or Toronto West (2700 Eglinton Ave W). It's printed on your summons, not decided by where you live.

Was my vehicle impounded after a Toronto stop — what do I do?

Deal with it right away. Storage and towing fees accrue daily and are entirely separate from anything the court orders later, so the cost keeps growing the longer the vehicle sits.

This may not be the whole picture — here's how we handle other charges in Toronto, and how Driving Without Insurance plays out in other Ontario cities.
