Distracted Driving in Toronto — how it actually works
Toronto Police Service patrols the municipal expressways — the Don Valley Parkway and the Gardiner — along with arterials like Lake Shore Boulevard, while the OPP covers the 400-series highways through the city. A s.78.1 Highway Traffic Act charge for a hand-held device can be laid by either, and Toronto is the only city in Ontario with three separate Provincial Offences courts to hear it, decided by where the ticket was issued.
It's a Part I ticket on paper, but the consequence is not typical of one: a conviction suspends your licence starting with the first offence — 3 days, then 7, then 30 — stacked on a fine starting at $500 and 3 demerit points. Yes. That's the literal wording Ontario officers write on the ticket for a s.78.1 Highway Traffic Act charge, generally called distracted driving. If your ticket reads that way, this is your charge.
Is the suspension for a Toronto distracted driving ticket different from elsewhere?
No — the Highway Traffic Act sets the suspension province-wide, not the court that hears it. A first conviction carries a 3-day suspension on top of the fine and 3 demerit points, rising to 7 days on a second and 30 on a third, at any of Toronto's three courts.
Which of Toronto's three courts hears a distracted driving ticket?
Whichever one serves the area where the ticket was issued — Toronto South (92 Front St E), Toronto East (1530 Markham Rd), or Toronto West (2700 Eglinton Ave W). It's printed on the notice you were served, not decided by where you live.
